Case Synopsis
Kristopher Peerali, Serena Peerali, and Ali Hosseini secured a combined $2,004,999.98 settlement for four family members – including a minor – who suffered spinal injuries, traumatic brain injuries, and other serious harm after a commercial vehicle rear-ended their car at speed on Interstate 680 near Fremont.
On November 7, 2021, the plaintiffs were traveling on I-680 near Fremont when a commercial vehicle operated by the defendants struck their vehicle from behind at speed. The impact caused a range of serious injuries across the family: one plaintiff sustained spinal and orthopedic injuries that affected their ability to work; a second suffered spinal injuries along with a traumatic brain injury; a third – a minor – suffered a traumatic brain injury and PTSD; and a fourth sustained cervical spine and connective tissue injuries, which resolved separately.
Every plaintiff faced an active causation dispute from the defense insurer, who pointed to gaps in treatment and limited early medical care to argue that the injuries were unrelated to the crash or overstated. Liability was also contested. Before Peerali Law took the matters to litigation, the insurer’s pre-litigation offers reflected how little it valued the claims – as low as $3,900 for the minor plaintiff and $12,700 for the fourth plaintiff, with the two most seriously injured plaintiffs offered just $50,000 and $40,000. Rather than accept those figures, the firm built a coordinated litigation strategy across all four claims, pushing each case through expert discovery to build the evidentiary record on both causation and damages for every claimant individually.
By the time expert discovery concluded, the insurer’s position had become difficult to defend across the board, and the matter resolved before trial for a combined $2,004,999.98 – more than thirty times the plaintiffs’ collective pre-litigation offers.
