Kristopher Peerali and Serena Peerali secured a $450,000 settlement for a driver who suffered neck and low back injuries after a police pursuit collision in Daly City set off a chain-reaction crash – a recovery Peerali Law obtained without the plaintiff ever having to sit for a deposition.
Our client was stopped at a red light at an intersection when a police vehicle, responding “Code 3” with lights and siren activated for an emergency, sped unreasonably through the intersection. The police vehicle was struck by another car, which spun out of control and slammed into our client’s vehicle. He underwent conservative treatment for neck and low back pain, including chiropractic care and trigger point injections.
Liability was the central challenge. California law affords significant protection to officers responding to emergencies, and proving negligence during a Code 3 response is inherently difficult. Our attorneys built the case around a focused theory: that the officer failed to respond to the Code 3 call with due regard for the safety of others on the road. Through litigation, they established that the officer’s manner of driving through the intersection – despite having lights and sirens on – was unreasonable under the circumstances, and secured fault against the City of Daly City on that basis.
